Question About Motion Capture Devices and Software

I am trying to see if it's possible to grab motions from video's you watch online with software. I am familiar with the way movies studio's do it, and I am also aware of the playstation and xbox Kinect versions using camera's to record your own motions. What I don't know is if I see an action in a video I see online, is there software available to capture that?

It exists, but it tends to be either very expensive or very labor intensive, unless the video has been specifically shot for mo-cap with markers on the moving subject, A program like Zign-Track can pull a facial mo-cap from markerless data at a fairly reasonable price because all human faces are basically very similar, but there's such a huge difference between individual humans when it comes limb and torso proportions that it would be extremely difficult to pull enough data from a single-perspective video source to be convincing (hence the common use of the T-bar positin in most markerless mo-cap work.) $$$ for time invested, programs using depth sensors like the Kinect are so much more effective that a large number of Pro studios have switched over to using them.
Also, keep in mind that anything that you see online is legally considered a performance and duplicating the actions without permission can get you onto some shaky legal ground as the law considers what you have produced to be a derivative work. You could probably get away with capturing something like a basic walk cycle, but directly copying a gymnast's routine, choreographed dance, or an action sequence from a movie should be avoided if you ever plan to show the work publicly.
Ok thanks for the info. The basic idea I had was to capture the motion, but to also work on it, thereby making it my own and not a duplicate. It would be for everyday actions that are not already available, but also dance, though I was looking for basic dance steps to build from, like you would get if you took dancing lessons. There are many types of dance out there that you can get dance lessons for and in my mind, considered generic and useable by anyone. What is currently available from animate is limited and need work.

I know you said you knew about the Kinect for animation but just in case you or any one else are unaware of these ones, here are a few links you might be interested in.

You can Record an animation with the FREE KINECT depth movie recorder from http://freemocap.com/, then send your depth movie to freemocap.com and they will send you back the animation as a .BVH or FBX, FREE of charge!
Have you tried Ikinema-webanimate, it has a free limited version, plus some paid versions which seem reasonable, but you have to be online to play with it.

Animstreet has lots of free motions, you have to register to download them. Go to the link below and in the search clips window type price=0 ,It will bring up 10 free clips at a time. If you have a fast connection the clips will animate right away and if you have a slow connection wait a little and it show you what the motions looks like.

The store them seems not to have had any update since 2012.
But I bought something there in 2013. But great care is good.
there are 2 their set (animals motions), for sale at Renderosity.
I have all the packages motions poser / daz, Store them ... Oops least the motions for genesis, only motions to M3, M4, V3, V4.
But the characters that I'm around now, are toons, most nursoda, (and later an old man rex 3duniverse) among others with skeleton differs: m3, m4, v3 and 4.
But then, now I paid an annual plan Ikinema Webanimate, I'll be able to retarget all motions poser / daz M3, 4, and V3, 4 for the toons.
