I know there has been some question about the EULA, and how it pertains to gifting. There has even been a quote from a CS person at Daz 3D as part of that discussion. I wanted to jump in and clear things up.
In the EULA, as it regards 3D prints, users are permitted to 3D print content for "personal, non-commercial use by the User."
The question has airsen about then gifting those items, as well as what is commercial vs. non-commercial. To answer, this, it's important to look at the legal definition of "commercial use" is as follows:
According to 18 USCS § 31, term "used for commercial purposes" means the carriage of persons or property for any fare, fee, rate, charge or other consideration, or directly or indirectly in connection with any business, or other undertaking intended for profit.
So, if that statement applies to your use case, then your use is considered commercial. If not, it's non-commercial. Furthermore, so long as your use case is non-commercial, you are allowed to give 3D prints that you buy as gifts to others.
I know that this was confused by a specific customer ticket and interaction with CS (Customer Service) at Daz 3D which seemed to indicate that businesses were also allowed to give prints away to customers so long as they did not sell them. That issue has been addressed with the one customer affected by it, and has been resolved. We apologise for any confusion that may have caused.
If you have specific needs for some 3D printing that you feel may be considered commercial use,and would like to find out for sure, and se if there is a way for you to get permission to do so for now, then please open a ticket with CS so we can review your specific situation and needs.

as I am the person you quote as "confused", let me state clearly that my question in my original request to CS was NEVER about businesses giving away something for free. It was always about me as a private person making a gift to somesome dear to me. I have attached the full text of my question to CS.
Essentially, the new reply I got from CS makes me a business in the spirit of the print, even though I am a private person not using the print in any business way, and certainly not getting any money out of it, or receiving it. Honestly, I don't know what to think now, except that I will order a few less figures from Gameprint now, as a result of the CS mail. Because I can't even buy that commercial license I need to print those presents for my friends and family.
At least, I am still allowed to let my friend have her presents and don't have to retrieve them from her.
Apologies if my post came across as stating that you were confused. I did not feel you were confised. I felt that our CS person was confused and gave you bad information (or at least incomplete, as an item being a gift or not is not entirely what determines if it is or is not commercial.) I'll grab the support ticket and follow up with you personally so we can work it out.

Maybe you check out Request #261331 too, as that was my second ticket with a request for public clarification. There seems to be some misunderstanding there, too, in the reply.
